Suit filed over sidewalk fall

SANDPOINT — An Arizona woman who was injured in a fall on a Sandpoint sidewalk is suing the city and the Idaho Transportation Department for negligence.

Counsel for Joanne Mark said her client tripped on a Pine Street sidewalk in the fall of 2010. The woman had a concussion, a gash above her left eye, and bruised limbs, according to the civil complaint. The woman’s upper dental plate also broke, causing lacerations to her mouth, the suit said.

Mark’s Coeur d’Alene attorney, Melanie Ballie, said the woman was walking on the north side of Pine between First and Second avenues when she tripped.

Mark’s counsel filed suit on July 10 in 1st District Court. The suit seeks more than $10,000 in damages

for negligence, loss of consortium and negative infliction of emotional distress.

The city and state’s legal responses to the suit are pending.
