Sentencing is delayed in case

SANDPOINT — Sentencing is on hold for a Spirit Lake man who pleaded guilty to engaging in lewd and lascivious conduct with a minor.

Roy Lewis Baldwin was to be sentenced Monday in 1st District Court, but his defense counsel, Sandpoint attorney Bruce Greene, moved to disqualify newly-seated district Judge Barbara Buchanan, court records indicate.

Under Idaho’s criminal court rules, the state and the defense each have the right to disqualify without cause a judge or magistrate from presiding in the case.

A new sentencing date is pending.

Baldwin, 66, had sexual contact with a girl from 2008 to 2012, when she was between the ages of 6 and 10, charging documents allege.

Baldwin is free on his own recognizance while his case is pending.
