Court upholds CDL suspension

SANDPOINT — The Idaho Court of Appeals is upholding the suspension of a Sagle man’s commercial driver’s license because of a drunken-driving arrest in 2009.

Raymond Scott Peck was stopped for speeding in Sandpoint and the officer detected the odor of alcohol and other signs of alcohol use. Peck was arrested after he declined to perform field sobriety tests.

Peck’s blood alcohol content was measured at 0.083 and 0.086, just over the legal limit to drive. Although Peck was not driving a commercial vehicle at the time of his arrest, his CDL was seized pursuant to state law and suspended for one year.
