Hankey cases headed for dismissal

SANDPOINT — The state is moving to dismiss two more lewd conduct cases because a witness recanted her testimony in a related case.

The motions to dismiss Frank Donald Hankey and Diane Lynn Hankey’s cases are slated to be heard today in 1st District Court.

Bonner County Prosecutor Louis Marshall moved to dismiss the cases in light of a teen’s recantation of her testimony, which was demonstrated in the trial of Ernest Ray Johnson III in July.

“Due to this recantation, the state is unable to prove the case beyond a reasonable doubt,” Marshall said in the motion, which was filed on Thursday.
