County files counterclaim in access dispute

SANDPOINT — Bonner County filed a counterclaim against a couple accused of encroaching on a public right of way northwest of Clark Fork.

The counterclaim against Matthew and Elizabeth Deen was filed in 1st District Court last Monday. It alleges that a public right of way has existed across their property for more than a century.

The route, originally known as Brush Road, was a wagon road that later became a motor vehicle road that connected Sandpoint and Clark Fork, according to the suit. It was constructed in 1903 as an alternate route linking Hope and Clark Fork because seasonal flooding of the Clark Fork River Delta made the Kootenai-Cabinet Road impassible.
