Why is Festival still at War Memorial Field?

Why is the Festival at Sandpoint still at War Memorial Field? In 1993 , to settle a lawsuit, The Festival at Sandpoint and the city of Sandpoint made an agreement with the area residents that the last year The Festival at Sandpoint would be held at War Memorial Field would be 1995. What happened to the agreement?
