ORDINANCE NO. 548 AMENDMENT TO BCRC TITLE 11 (BUILDING REGULATIONS) REGARDING EXEMPTIONS An Ordinance of Bonner County, Idaho, setting forth its authority; amending Title 11, Chapter 1, of the Bonner County Revised Code, by providing additional exemptions for certain structures, repealing the requirement for proof of building location permit prior to energizing a structure, and adjusting the health district authorizations based upon revised exemptions, providing for severability and providing for an effective date. Whereas, the Bonner County Board of Commissioners has established a building location permit process in the unincorporated areas of Bonner County; and Whereas, the Board of Commissioners wishes to make certain revisions to Title 11 (Building Regulations), Bonner County Revised Code (BCRC) to amend the types of structures eligible for permit exemptions, to eliminate the requirement for proof of a building location permit prior to energizing a structure, and to adjust the exceptions for health district authorizations; and Whereas, the Bonner County Board of County Commissioners did consider the proposed amendments to Title 11 at a regularly scheduled meeting on December 8, 2015, in order to receive public comment on said ordinance changes. Now, therefore be it ordained by the Board of County Commissioners of Bonner County, Idaho that the following be and is hereby adopted as an ordinance of Bonner County Section 1 Authority This Ordinance is adopted pursuant to the authority granted at Chapter 7, Title 31, Chapter 8, Title 31, Idaho Code, and Article XII, Section 2 of the Idaho Constitution, as amended or subsequently codified. Section 2 Amending Chapter 1 Of Title 11, Bonner County Revised Code, by providing for the following Part A Section 11-101 of the Bonner County Revised Code is hereby amended to read as follows 11-101 BUILDING LOCATION PERMITS REQUIRED Except as otherwise provided in this title, no structure subject to the provisions of this title shall be erected, constructed, reconstructed, set, placed, installed, enlarged, extended, moved or converted in unincorporated Bonner County without first procuring a building location permit from the Bonner County planning department prior to the start of construction. Applications for such permit shall be made on forms provided by the planning department. Part B Section 11-104 of the Bonner County Revised Code, Paragraph B, subparagraphs (1) through (3) are hereby amended and a new subparagraph (4) is hereby added, to read as follows 11-104 EXEMPTIONS B. The structure is one of the following 1. An accessory, nonresidential structure that is a detached structure used as tool or storage shed, playhouse, carport, shop, and similar use, provided the floor area does not exceed one thousand (1,000) square feet. 2. A detached agricultural structure designed or constructed solely for the purpose of storing or housing hay, grain, poultry, livestock, produce, horticultural products or agricultural equipment, provided the floor area does not exceed one thousand (1,000) square feet. Such structure shall have no sewage disposal utilities and shall not be inhabited; a place of employment; or a place where products are erected, constructed, enlarged, improved, converted, demolished, processed, treated, or packaged for sale; nor shall such structure be a place used by or accessible to the general public. 3. A nonhabitable, open structure, such as a deck or lean-to that is an addition to a residential structure, provided the total floor area of the addition does not exceed six hundred (600) square feet and provided the addition is not made to a previously exempted structure that would cause it to exceed six hundred (600) square feet. Said structure shall have no sewage disposal utilities. 4. A nonhabitable, open structure that is an addition to an agricultural structure, provided that the total floor area of the addition does not exceed eight hundred (800) square feet and shall have no sewage disposal facilities. Part C Section 11-110 of the Bonner County Revised Code, Paragraph A is repealed in its entirely and Paragraph B is hereby renumber new Paragraph A and is amended to read as follows 11-110 AGENCY AUTHORIZATIONS A. No building location permit shall be issued for the construction, placement, installation, enlargement or extension of any building, residence, or structure unless approval has first been obtained from a Panhandle health district official or applicable sewer utility official. 1. Exceptions Approval from the Panhandle health district or sewer utility official shall not be required for the following (Exceptions from permit requirements shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of this code or any other laws or ordinances of Bonner County or other local, state or federal laws. All structures shall meet the separation distance requirements to the on-site septic tank, drainfield, or drainfield replacement area pursuant to the state of Idaho's individual/subsurface sewage disposal rules [Idaho administrative procedures act (IDAPA) 58.01.03]. The landowner/agent shall comply with the "one number locator" [Call Before You Dig] regulations of Idaho Code title 55, chapter 22.) a. Signs. b. A single addition to an existing residence or residential accessory structure used solely for storage or agricultural uses such as woodsheds, lean-tos, greenhouses, general storage provided, however, that the addition (1) Has a total floor area not exceeding six hundred (600) square feet; (2) Has no sewage disposal utilities; c. Balconies, eave extensions, or other similar structural features not requiring new construction of support beams, foundations or other structural support located on the ground, as determined by the planning director to be eligible for the exception due to the location of the structural addition. Section 3 Severability The provisions of this Ordinance are hereby declared to be individually severable. Should any provision of this ordinance be declared invalid by a court of competent jurisdiction, such declaration shall not affect the validity of the remaining provisions. Section 4 Effective Date This Ordinance shall be in full force and effect upon its passage and publication in one (1) issue of the Bonner County Daily Bee Newspaper.
