Ordeal reads just like a cheap novel

| July 7, 2015 7:00 AM

In response to the dispute surrounding the 1903 road — formerly Brush Road also known as the Spring Creek Road and Shadow Valley Lane — I have uncovered a few facts.

After 112 years, the road was never physically graded by the government but was approved as a public road by the commissioners of Kootenai County after Bonner County was created. A question of constructive notice comes to mind as even title companies have failed to reflect it in their policies. The 1903 document does not reflect the owner at the time or Section (23) that the barn/house is mostly situated on.
