SANDPOINT — A lawsuit accusing a former Schweitzer Mountain Resort resident of maliciously damaging scores of chairlift seat covers has been dismissed.

Counsels for the resort and David Donald Markwardt jointly moved on earlier this month to dismiss the case with prejudice and without any fees or costs awarded.

First District Judge Barbara Buchanan granted the dismissal on April 21, court records show.

The dismissal occurred a week before the suit was scheduled to be tried. There were also efforts to settle the matter through mediation.

“There was no monetary settlement,” said Peter Erbland, a Coeur d’Alene attorney who represented Schweitzer.
