June 9, 1966 — CHARGE DISMISSED
In district court Judge James Towles of Wallace dismissed the reckless driving charge against Sheriff Robert Butigan ruling the charge against him had been improperly drawn. Towles ruled that under Idaho statutes, criminal actions must be filed in the name of the state. The charge had been filed in the name of the city of Sandpoint.
Dar Cogswell, city attorney, who prepared the charge filed by Chief Elliot, said the city would continue to press the case against Butigan.
The case can be refiled under the name of the state of Idaho to conform to the decision.
