Conditions of Approval: 1. The vacation of the above-described right-of-way shall be effective upon the recording of a resolution by the Bonner County Commissioners granting the vacation. 2. Title to the vacated roadway shall be vested as follows: [Idaho Code 50-311, as per 50-1320, provides the land shall "revert to the owner of the adjacent real estate, one-half on each side thereof, or as the city council (or commissioners) deems in the best interest of the adjoining properties, but the right of way, easements and franchise rights of any lot owners or public utility shall not be impaired thereby." Additionally, right-of-way which is abandoned within a given subdivision must be vested to landowners within the subdivision and may not be granted to lands in other subdivisions or unplatted lands.] 3. The costs for legal advertisements and recording fees shall be borne by the applicant and shall be paid prior to the recording of the resolution vacating the right-of-way. 4. The proposed deeded right-of-way dedication of Westmond Road shall be 50-feet wide (25-feet each direction from centerline). With a 5 foot easement granted by the applicant.
