Ordinance No. 562 Title 9, Emergency Communications System (911), Amendment Chapter 2, Section 207, Agency to Service Calls Bonner County Revised Code (BCRC) AN ORDINANCE OF BONNER COUNTY, IDAHO, SETTING FORTH ITS AUTHORITY; AMENDING BONNER COUNTY REVISED CODE TITLE 9 (EMERGENCY COMMUNICATIONS SYSTEM (911)), CHAPTER 2, SECTION 207 (AGENCY TO SERVICE 911 CALLS) AND PROVIDING FOR SEVERABILITY, AND PROVIDING FOR AN EFFECTIVE DATE. Whereas, the Emergency Communication Act Chaper 48 of Title 31 of the Idaho Code gives the Board of County Commissioners of Bonner County the authority to establish a county-wide consolidated emergency communications system, commonly known as a 911 system; and Whereas, the Bonner County Board of Commissioners passed an Ordinance authorizing the establishment of a 911 system on the 5th of June, 1997; and Whereas, at the general election in November, 1996, the voters of Bonner County, approved and authorized the Board of County Commissioners to institute a telephone line user fee in an amount no greater than one dollar ($1.00) per month to be used to fund the emergency telephone system, commonly known as 911 service; and Whereas, pursuant to Section 31-4802, Idaho Code, the Board of County Commissioners in the "governing board" for a county wide 911 system; and Whereas, pursuant to Section 31-4083, Idaho Code, the governing board has the ability to designate the agency to service the 911 calls, and the Board of County Commissioners do desire to designate a new agency to service the 911 calls. Now, therefore be it ordained by the Board of County Commissioners of Bonner County, Idaho that the following be and is hereby adopted as an Ordinance of Bonner County: Section 7: AGENCY TO SERVICE THE 911 CALLS The Bonner County Sheriff's Department is hereby designated pursuant to Section 31-4803, Idaho Code, as the agency to service the 911 calls. SEVERABILITY The provisions of this Ordinance are hereby declared to be individually severable. Should any provision be declared invalid by a Court of competent jurisdiction, such declaration shall not affect the validity of the remaining provisions. EFFECTIVE DATE This Ordinance shall be in full force and effect upon its passage and thirty (30) days after the publication date in one (1) issue of the Bonner County Daily Bee, in accord with the provisions of Section 31-715, Idaho Code.
