Felony battery cases resolved

SANDPOINT — A pretrial settlement agreement is resolving a felony kidnapping and battery case against a Bonner County man.

Shane Alan Carson was charged with holding a man against his will and breaking his nose during an attack in Priest River last March. Lance Joseph Sinka was also implicated in the alleged attack and similarly charged.

The alleged victim, 34, told investigators he entered a home on Lincoln in response to allegation he had stolen a bike and guitar, allegations which he denied.

Carson, 30, and Sinka, 43, allegedly jumped the man when he entered the residence and was subjected to a prolonged beating in which he was kicked in the face, choked out and threatened with a knife, according to a probable cause affidavit.

In a pretrial settlement agreement, Carson pleaded guilty to an amended charge of attempted aggravated assault. In exchange for the plea, the kidnapping charge was dismissed, court records indicate.

The state is recommending a 45-day jail sentence and full restitution, which has yet to be determined. Carson is scheduled to be sentenced on Nov. 7.

Sinka, meanwhile, pleaded guilty to a reduced charge of misdemeanor battery and the kidnapping charge was dismissed, according to the Idaho Supreme Court Data Repository. He was sentenced to 90 days in jail with 70 days suspended and credit for 20 days of pretrial incarceration.
