NOTICE OF PUBLIC MEETING NOTICE IS HEREBY GIVEN that the Bonner County Plan- ning Department will hold a public meeting beginning at 6:00 p.m. on Wednesday, November 7, 2018, at the Priest Lake Elementary School located at 27732 Hwy. 57, Priest Lake, regarding the fol- lowing: Bonner County Planning is looking to form a committee to assist in writing an area comprehensive plan for Priest Lake. The County is con- cerned with the potential im- pacts of current and trending growth pressures. This plan will aid the County in determining where and how growth should occur. The Planning & Zoning Commission has determined the committee will consist of 9 individuals and 3 alternates. The 12 individuals will include a minimum of 5 owning property and living in the area, up to 2 renting in the area, and up to 2 owning property in the area but not permanently residing in the area. SUMMAR OF ORDINANCE NO. 596 AN ORDINANCE OF THE CITY OF PRIEST RIVER, BONNER COUNTY, IDAHO, PROVIDING FOR AUTHORITY; GRANTING THE VACATION OF THE PLAT OF SETTLERS' RIDGE; PROVIDING FOR CONDITIONS OF SAID VACATION; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council did approve the Settlers' Ridge Planned Unit Development and associated subdivision plat located in Sections 29 and 30, Township 56 North, Range 4 West, Boise Meridian, Bonner County, Idaho; and WHEREAS, said Settlers' Ridge Planned Unit Development subdivision plat was recorded October 11, 2011 at Book 10 Page 98 of plats as Instrument Number 816352; and WHEREAS, only two lots of the thirteen-lot Planned Unit Development subdivision have been sold and housing market conditions have changed since the recording of the plat; and WHEREAS, the current landowners of the property depicted in Exhibit A have communicated to the City they request to have the entire plat and the associated Planned Unit Development vacated; and WHEREAS, the current landowners of the property depicted in Exhibit A delivered to the city a request for a vacation of the Settlers' Ridge Planned Unit Development plat together with an application for River Vista Estates, a four-lot subdivision without a Planned Unite Development; and WHEREAS, the City Council considered said request at a duly noticed public hearing on May 7, 2018 and has proceeded with the vacation request in accordance with §50-1306A, Idaho Code; and WHEREAS, upon hearing testimony and deliberating, the City Council decided to grant the vacation request; NOW THEREFORE, THE CITY COUNCIL OF PRIEST RIVER, IDAHO HEREBY ORDAINS AS FOLLOWS: SECTION 1 Authority for this ordinance is given within Title 50, Chapter 13, Idaho Code. SECTION 2 The Settlers' Ridge Subdivision, recorded as Bonner County Instrument 816352 and depicted in Exhibit A, by this reference incorporated herein, in accordance with provisions contained in Title 50, Chapter 13, Idaho Code, is hereby vacated subject to conditions itemized below: Condition 1 Prior to the recording of this vacation ordinance, the landowners shall prepare and deliver to the City document(s) ready for recording that will nullify any & all recordings of covenants, conditions and restrictions associated with the Settlers' Ridge subdivision. Said document(s) shall be supplied to the City so that related recordings can be recorded sequentially. Condition 2 Prior to the recording of this vacation ordinance, the landowners shall prepare for recording a subdivision plat in accordance with the City Code and City Council's approval of the River Vista Estates subdivision as depicted in Exhibit B which, by this reference is incorporated herein. Said plat shall be supplied to the City so that related recordings can be recorded sequentially. SECTION 3 No existing utility easements are affected by the vacation. The access road depicted on the Settlers' Ridge plat was never constructed. An existing access easement containing a previously constructed road and paralleling the road easement depicted on the Settlers' Ridge plat will serve as the access to River Vista Estates and will be depicted on the plat thereof. SECTION 4 The provisions of this ordinance are hereby declared to be individually severable. Should any provisions of this ordinance be declared invalid by a court of competent jurisdiction, such declaration shall not affect the validity of the remaining provisions. SECTION 5 This ordinance shall be in full force and effective upon recording with the Bonner County Clerk and publication in one issue of the Bonner County Daily Bee.
