Man is accused of sexual abuse

SANDPOINT — A Sandpoint man was arrested for sexually abusing developmentally disabled man at an assisted-living facility on Tuesday.

Kerry Scott Stewart is charged with sexual abuse of a vulnerable adult, a felony that punishable by up to 15 years.

Stewart, 54, was scheduled to make an initial appearance in Bonner County Magistrate Court on Wednesday. Online court documents from the hearing were not immediately available, however.

Sandpoint Police were summoned to Lakeside Assisted Living at 9:30 p.m., after receiving a report that Stewart performed fellatio on a male resident against his will, according to a probable cause affidavit.

The alleged victim told police he told Stewart to stop, but he refused, which prompted nursing staff to intervene, the affidavit said.

The affidavit further states that Stewart is HIV positive.

Stewart told police the sexual contact was consensual.

A preliminary hearing in the case is set for April 17.
