Judge rejects gun lawsuit stay request

SANDPOINT — A First District Court judge rejected Bonner County’s motion to stay its lawsuit Tuesday to give the Idaho Legislature a chance to debate the issue.

District Judge Lansing Hanynes said Sandpoint city officials and the Festival at Sandpoint need to know how to plan for the coming summer concert series, set for Aug. 6-16.

“Once you file the lawsuit, you’re in for a dime or in for a dollar,” Judge Lansing Haynes said on why the county should have waited to see what the Legislature was going to do before filing suit.

The motion to deny the stay request was part of a status conference in the county’s lawsuit over a firearms ban at the Festival at Sandpoint. Bonner County had filed an amended complaint in late March asking the court to determine if the gun ban violates Idaho law.
