Charge added in rape case

SANDPOINT — An investigation in a Sagle rape case has produced another felony charge against the suspect, court records show.

Devan James King was charged with sexual exploitation of a child after a search of a cellphone he was using turned up an image of the alleged victim in the rape case topless. Detectives surmised the image was taken by the teen, although it was stored on a phone King had in his possession when he was arrested earlier this month, according to a probable cause affidavit.

King, 42, is being held at the Bonner County Jail in lieu of $75,000 bail, court documents indicate. A preliminary hearing in the rape case is set for Nov. 4 in Bonner County Magistrate Court.

If a court rules there is sufficient evidence, King will be bound over to stand trial in 1st District.

King is accused of raping a 16-year-old girl at his home on Oct. 5. The teen told investigators that King pinned her to a bed. A criminal complaint alleges the teen resisted, but that resistance was overcome by force or violence.

King denied raping the teen when he was questioned by sheriff's investigators, the affidavit said.

The teen immediately reported the incident to a sexual abuse hotline, in addition to authorities in Bonner County, according to court documents.

The teen underwent a rape examination at Kootenai Health in Coeur d'Alene. Bedding and an undergarment worn by the teen were taken as evidence in the case, court records show. Investigators also obtained a warrant to collect a DNA sample from King.

If convicted of the rape charge, King faces a prison sentence of one year to life. The sexual exploitation charge is punishable by up to 10 years in prison, according to Idaho Code.
