SUMMARY OF ORDINANCE 157 AN ORDINANCE OF THE CITY OF PONDERAY, BONNER COUNTY, IDAHO, PROVIDING FOR THE AMENDMENT OF CITY CODE TITLE 8, CHAPTER 4, ENTITLED STORMWATER MANAGEMENT AND TITLE 9, CHAPTER 5, SUBCHAPTER 3 (PCC9-5-3) PERFORMANCE STANDARDS, ENTITLED ADDITIONAL RESTRICTIONS FOR MULTIPLE FAMILY DWELLINGS; AND PROVIDING FOR THE PUBLICATION AND THE EFFECTIVE DATE HEREOF. Section 1 provides for an amendment to Ponderay City Code (PCC) Title 8, Chapter 4 to allow for the use of the Idaho Department of Environmental Quality Best Management Practices for stormwater management; creates definitions for BMP Manual, Critical Storm, Peak Discharge Rate, Storm Duration, and Storm Intensity, modifies the definition of a Design Storm and removes the Grassed Infiltration Area definition; clarifies that only Idaho licensed civil engineers or landscape architects can prepare stormwater management plans; allow for stormwater management facilities as described by the Idaho Department of Environmental Quality Best Management Practices; clarifies design standards; removes the one-half inch impervious runoff treatment volume; and removed the grassed infiltration areas design requirement; Section 2 provides for an amendment to PCC 9-5-3, Additional Restrictions for Multiple-Family Dwellings, removing subsection E, which limited the combined floor area of all residential structures, including common space to 50% of the total surface area of the lot, removing subsection F, which limited Vehicular and Pedestrian Areas to 35% of the total surface area of the lot and reindexing subsection G to become the new subsection E; Section 3 provides for publication and an effective date of June 15, 2021. The proposal would also modify PCC 9-4D-3, INDUSTRIAL USES PERMITTED and PCC 9-4D-4, INDUSTRIAL SPECIAL USES. Additionally, the proposed amendment would modify, Title 9, Chapter 5A, Section 4 to allow for construction of three-story structures by right where currently planning commission approval is required when a structure exceeds two stories. The Ponderay Planning and Zoning Commission recommended approval of the proposed text amendment with revisions at the June 9th public hearing.
