SUMMARY OF City of Kootenai ORDINANCE NO. 231 A summary of the principal provisions of Ordinance No. 231, of the City of Kootenai, Bonner County, Idaho, adopted on the 5th day of May, 2021, by the City Council, is as follows: AN ORDINANCE of the City of Kootenai, Idaho granting a non-exclusive franchise to Fatbeam, LLC ("Fatbeam" or "Company") to construct, operate and maintain a Telecommunications System, with all necessary facilities, within the City of Kootenai, Idaho (the "City"); setting forth provisions, terms and conditions accompanying the grant of this Franchise; providing for City regulation of construction, operation, maintenance and use of the Telecommunications System; prescribing penalties for the violations of its provisions; and setting an effective date. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF KOOTENAI, that Ordinance No. 231 is hereby effective upon the passage and publication as provided by law. ORDINANCE NUMBER 2021-1 AN ORDINANCE OF THE CITY OF OLDTOWN, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, AMENDING THE ZONING DESIGNATION OF CERTAIN PROPERTY WITHIN THE CITY OF OLDTOWN; CITING AUTHORITY; PROVIDING FOR THE CHANGE OF ZONING DESIGNATION FROM LIGHT INDUSTRIAL TO RESIDENTIAL; PROVIDING FOR REPEAL OF CONFLICTING ORDINANCE PROVISIONS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a landowner has requested a residential building permit for certain lands it owns; and WHEREAS, said lands are currently zoned Light Industrial and limit residential development; and WHEREAS, the City Council desires to address the current lack of housing within the City; and WHEREAS, the Mayor and City Council conducted a public hearing on April 12, 2021 and have deemed it in the long-term public interest of land use development in the City of Oldtown to amend a particular zoning designation and have found said request to be in accordance with the comprehensive plan. NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF OLDTOWN, IDAHO AS FOLLOWS: Section 1 Authority The authority used by the City to adopt this ordinance is granted at 67-6511, Idaho Code. Section 2 Subject Property The subject property is described as: That portion of the Burlington Northern and Santa Fe Railway Company's (formerly Great Northern Railway Company) 250.0 foot wide Station Ground property at Oldtown, Idaho, situated in Government Lot 1 of Section 25m, Township 56 North, Range 6 West, Boise Meridian, Bonner County, Idaho, described as follows: Beginning at the most Westerly corner of Lot 1, Block 5 of Norton's Addition to Oldtown, Idaho; Thence Northwesterly along the Northeasterly line of the one acre tract, conveyed to Eliza Thompson by deed dated October 30, 1899, a distance of 136 feet, more or less, to the intersection with a line drawn concentric with and 50.0 feet Southeasterly, as measured radially from said Railway Company's Main Tract centerline; Thence Northeasterly along the last described concentric line 107.0 feet; Thence Southeasterly to a point on the Northwesterly line of said Block 5, 145.9 feet Northeasterly of the Point of Beginning; Thence Southwesterly along said Northwesterly line 145.0 feet to the Point of Beginning. The subject property is generally depicted within attached Exhibit 1. Said Exhibit is hereby made a part of this Ordinance. Section 3 Zoning Designation The subject property identified in Section 2 is hereby zoned Residential. Section 4 Zoning Map The Official Zoning Map shall be amended accordingly to depict the Residential designation identified in Section 3 above. Section 5 Severability This ordinance is hereby declared to be severable. Should any portion of this ordinance be declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purpose(s) of the ordinance before the declaration of partial invalidity. Section 6 Repeal of Conflicting Provisions All provisions of current ordinances of the City of Oldtown which conflict with the provisions of this ordinance are hereby repealed to the extent of such conflict. Section 7 Effective Date This ordinance shall be effective upon its passage and publication as provided by law.
