The subject lands are generally located north of Grandview Avenue accessing by private road off of Auxor Road and are more particularly described as: The Northeast Quarter of the Northwest Quarter and the Northwest Quarter of the Northeast Quarter, less the Auxor Road right of way, all within Section 35, Township 57 North, Range 1 East, Boise Meridian, Bonner County, Idaho. PETITION FOR SUMMARY ADMINISTRATION OF ESTATE WHERE SURVIVING SPOUSE IS SOLE BENEFICIARY (I.C. 15-3-1205) IN THE DISTRICT COURT OF THE FIRST JUDICIAL DISTRICT OF THE STATE OF IDAHO, IN AND FOR THE COUNTY OF BONNER In the Matter of the Estate of: JOYCE EVELYN DUNTON, Deceased. Case No.:CV09-21-1770 Fee Category: D Fee: $130.00 Petitioner, JOHN R. DUNTON, states and represents to the Court that: 1. Petitioner's interest in this matter is that of the surviving spouse of the Decedent; 2. The Decedent, JOYCE EVELYN DUNTON, died on February 20, 2015 at the age of 84 years. See certified Death Certificate attached hereto as Exhibit A. 3. Venue is proper because at the time of death, the Decedent was domiciled in Bonner County and owned property located in Bonner County, Idaho; 4. Decedent, f/k/a JOYCE EVELYN BOYD, and Petitioner, JOHN R. DUNTON, were duly married in the City of Reno, County of Washoe, State of Nevada, on August 24, 1953 and remained married until the date of Decedent's death. See copy of County of Washoe Marriage records attached hereto as Exhibit B; 5. Decedent died intestate and her estate was not timely probated within three (3) years of decedent's date of death. Petitioner is Decedent's surviving spouse; 6. There is no need for a schedule of property to be attached to this Petition on account of the nature of Decedent's personal and real property, owned by the Decedent in the State of Idaho, on the date of Decedent's death, is properly characterized as community; and 7. Petitioner is the surviving spouse of the Decedent and therefore entitled to have all of the interest and estate of the Decedent distributed to and vested in him, free and clear of the claims of any person or persons claiming or attempting to claim under the estate of the Decedent as heir, devisee, or otherwise, except as a proper creditor. WHEREFORE, PETITIONER REQUESTS THAT: 1. The Court fix a time and place of hearing and that notice be given as required by law. 2. That the Court enter its Decree that the Decedent and Petitioner, hersurviving spouse, were duly married and that Petitioner is the surviving spouse of the Decedent and vested with all of the interest and estate of the Decedent, free of the claims of any person or persons claiming or attempting to claim under the estate of the Decedent as heir, devisee, or otherwise, except as a proper creditor.
