Ordinance No. 696    Title 12, Land Use Regulations Bonner County Revised Code An Ordinance of Bonner County, Idaho, setting forth its authority; amending Bonner County Revised Code Title 12 (Land Use Regulations), to make the following changes to various subchapters of chapters two, six, and eight; providing for severability and providing for an effective date. Be it ordained by the Board of County Commissioners of Bonner County, Idaho that Bonner County Code be amended the summary of which, reads as follows: TITLE 12 LAND USE REGULATIONS 1) BCRC 12-215 – Modification to the site plan requirements to zone change and comprehensive plan map amendment applications. Changes result in only requiring a site plan drawn to scale, and does not include location of structures, utilities, yards, etc. 2) BCRC 12-225 –Clarification for Conditional Use Permit code to conform to BCRC 12-127 and 12-223. Changes adds the Hearing Examiner as a decision maker, in accordance with BCRC 12-127. 3) BCRC 12-660, 12-621 and 12-812 – The proposed change to BCRC 12-812 is to avoid the misuse of the code as currently written. The proposed changes to the ratio calculations allows for a similar property shape creation as is currently allowed in the code. 4) BCRC 12-621 – Update to the submerged lands standard as it relates to lot or parcel design, removing submerged lands when calculating the depth to width standard. 5) BCRC 12-661 – Updates to Minor Land Division code to modify the 30 day processing time limit to 90 days, and update the minor land division final plat process.  6) BCRC 12-804 - A modification to the definition of a Driveway to avoid creating future non-conforming properties. 7) BCRC 12-818 – Update to the Recreational Vehicle (RV) Park definition to align with BCRC 12-496, redefining an RV park as any premises designated for the rental of 3 or more RV’s, rather than 2 or more RV’s. 8) BCRC 12-819 – Modification to the definition of a Street align with the Road and Bridge department, and GIS department street definition. NOTICE OF PUBLIC HEARINGS NOTICE IS HEREBY GIVEN that the City of Ponderay Planning and Zoning Commission will hold a public hearing on Thursday, August 10, 2023 at 5:30 p.m., to consider the following request: File SS23-047, Bonner Mall Plat, Bonner Mall Partnership is proposing a boundary adjustment between a platted lot of record and an unplatted parcel of land in order to transfer a portion of Triangle Square, Lot 2, containing an easement; to the benefitting parcel to the south. Both properties are owned by Bonner Mall Partnership. The property is zoned commercial and is located off Warbonnet Way (formerly referred to as the Bonner Mall Access Road) in Township 57N, Range 2W, Section 11, Boise Meridian, Bonner County.
