Man arrested on domestic violence charge
SANDPOINT — A local man is facing charges of domestic violence in the presence of a child after police say he allegedly shoved a woman, causing bodily harm.
According to court records, 28-year-old Kegan Smith was bringing the woman milk for her child when things allegedly became heated. The alleged victim told Sandpoint police officers that Smith came inside and went upstairs. When he came down, court records contend that Smith began yelling at the alleged victim about paying the bills. At this point, the alleged victim told police that Smith shoved her, causing her to fall into the couch.
Police noted in the probable cause affidavit a large red mark approximately the size of a softball near the alleged victim’s neck. The alleged victim confessed to hitting Smith with a broom after he shoved her in an attempt to protect herself. However, Smith told officers she allegedly attacked him with the broom first, court records said.
“There were no significant injuries visible,” officers wrote in the probable cause affidavit after examining Smith for injuries.
When they entered the residence, court records said officers noticed spilled milk in the entryway as well as many items thrown around the room. Additionally, officers noticed a young child running around. When asked where the child was during the altercation, the alleged victim told officers the child had been present and was screaming in fear during the entire ordeal.
“[The alleged victim] requested [Smith] be charged, however did not want him arrested,” officers wrote in the probable cause affidavit.
Smith was charged with one count of domestic battery in the presence of a child. A no contact order was issued by the officers and Smith will have a jury trial on Sept. 7.
