RESOLUTION 3-2023 CITY OF CLARK FORK CITY COUNCIL AFFIRMATION OF LOCAL EMERGENCY DECLARATION FOR LIGHTNING CREEK LEVEE   WHEREAS, pursuant to Idaho Code § 46-1011 the Mayor of the City of Clark Fork, Idaho has declared a local disaster emergency on the 3rd day May, 2023 due to a breach on the Lightning Creek Levee on the 3rd day of May, 2023; and   WHEREAS, said declaration sets forth legal and factual considerations in support of such declaration; and  WHEREAS, the City Council of the City of Clark Fork recognizes the imminent threat that a breach at the Lightning Creek Levee places on the community, its citizens, and their property; and   WHEREAS, such declaration activates the response and recovery aspects of applicable local or intergovernmental disaster emergency plans for the furnishing of aid and assistance; and   WHEREAS, the emergency referenced herein exists because of the significant destruction to the levee by the spring water runoff and potentially serious consequences of the levee breach for residents and visitors to the City of Clark Fork; and  WHEREAS, this emergency and potential consequences require state emergency assistance to supplement local efforts to safeguard life, health and property; and  WHEREAS, Idaho Code § 67-2808 authorizes the Council of the City of Clark Fork to declare an emergency and that the public interest and necessity may demand the immediate expenditure of public money without compliance with formal bidding procedures; and   WHEREAS, an emergency declaration must be filed with the Bonner County Recorder’s Office and given prompt and general publicity in compliance with Idaho Code.   NOW THEREFORE, the City Council of the City of Clark Fork does hereby declare:   That a Local Disaster Emergency exists and that all efforts will be made to protect the citizens and property of the City of Clark Fork through activation of all local disaster emergency plans and state emergency assistance; and   That this Local Disaster Emergency shall continue until the City Council expressly authorizes the discontinuance of such Declaration; and  That this Declaration of Local Disaster Emergency (“Declaration”) shall be promptly filed with the Bonner County Recorder’s Office; and   That prompt and general publicity shall be given by a press release notifying the public of this Declaration.   Approved by the City Council of the City of Clark Fork this 8th day of May, 2023. Notice of Public Hearings Notice is hereby given that public hearings pursuant to Idaho Code and Dover City Code have been set for the Dover Planning and Zoning Commission on JUNE 1, at 6:00 p.m. at Dover City Hall, 699 Lakeshore Ave., Dover, to consider the following: FILE AM25-23 – WIRELESS COMMUNICATION FACILITIES (CELL TOWER) STANDARDS - The City of Dover has initiated an amendment to its zoning regulations, Title 12 of Dover City Code, to establish definitions, standards, application requirements and procedures for the placement of wireless telecommunication facilities. The proposed amendment would replace an emergency wireless communication facilities ordinance adopted by the City of Dover earlier this year. The Dover Planning and Zoning Commission will make a recommendation to City Council, which will hear the amendment at a later date and make the final decision. FILE AM26-23 – RESIDENTIAL ACCESSORY STRUCTURES & NONCONFORMING STANDARDS - The City of Dover has initiated an amendment to its zoning regulations, Title 12 of Dover City Code, to: provide definitions for walls and attached and detached structures; set a maximum size in the Residential zone for residential accessory structures (such as garages) to not exceed the floor area of the residence; establish that residential structures are not for commercial uses; set standards for the repair and replacement of nonconforming structures; and confirm nonconforming lots or parcels remain eligible for development. The Dover Planning and Zoning Commission will make a recommendation to City Council, which will hear the amendment at a later date and make the final decision. The public is encouraged to attend the hearing or provide written response. Written material not exceeding 1 page may be read into the record the day of the hearing. Anyone wishing to speak at the hearing may do so in compliance with the public hearing resolution (copy available at City Hall.)
