CITY OF OLDTOWN ORDINANCE NO. 2023-2 AN ORDINANCE OF THE CITY OF OLDTOWN, BONNER COUNTY, IDAHO, PROVIDING FOR AUTHORITY; PROVIDING FOR ANNEXATION OF LANDS INTO THE CITY; PROVIDING FOR THE ZONING DESIGNATIONS OF THE SUBJECT LANDS; PROVIDING FOR REZONING THE ADJACENT LANDS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council did conduct public hearings on March 29, 2023 regarding an annexation request for a parcel generally East of the Albeni Falls Dam; and WHEREAS, the adjacent land was previously annexed by “shoestring” annexation processing, legal at the time, to facilitate issuing liquor licenses; and WHEREAS, “Shoestring” annexations are no longer provided for within Idaho Code but previous “shoestring” annexations can be expanded; and WHEREAS, the City Council, after hearing public testimony, found it in the interests of the City and current area landowners to annex the subject property; and WHEREAS, the City Council heard testimony regarding the proposed use of a transfer/sales yard for landscape rock and materials as being a permitted use with the City’s Light Industrial zoning designation; and NOW THEREFORE, THE CITY COUNCIL OF OLDTOWN, IDAHO HEREBY ORDAINS AS FOLLOWS: SECTION 1 Land described in this Section are hereby annexed into the City of Oldtown: Lot 1 Fiedler Meadows recorded as Instrument 943277 in Book 14, Page 40, Bonner County Records and as depicted on Exhibit A hereby incorporated herein.
