Pair claim BOCC oath improperly done

SANDPOINT — Two affidavits of maladministration were issued to commissioners Luke Omodt and Steve Bradshaw during the commissioners’ regular Tuesday meeting, with claims that they had added extra words to their official oaths of office.

The affidavits — issued by Dan Rose and Richard Gray — claim that the phrase “and laws” was added during Omodt’s swear-in ceremony. This, the men said, is a “serious matter of maladministration.”

“The oath of office protects the fundamental right of the people to hold their trustees accountable,” the affidavits said.

Both Rose and Gray are demanding that Omodt and Bradshaw show any constitutional provision that would allow any elected official to add words, make any other change to the official oath, or use a completely different oath other than the one expressed in the Idaho Constitution.

The men are also demanding the pair execute a proper oath of office within five days of receiving the affidavit — which would be Sunday.

If they refuse to do so, the affidavit states “you agree that all claims herein, shall stand against you as evidence and truth and fact and law in all courts of records … and that you do with full knowledge, malice and intent perform maladministration for not complying with the constitutional requirement to take the oath described in the Idaho Constitution before performing any duties requiring power granted by the people.”

“Please take notice that this is sent to you in the love of Jesus Christ so that you may take due care,” the affidavits closed with.

    Bradshaw
