Ordinance No. 707 Title 12, Land Use Regulations Bonner County Revised Code An Ordinance of Bonner County, Idaho, setting forth its authority; amending Bonner County Revised Code Title 12 (Land Use Regulations), to make the following changes to subchapters 12-332, 12-333, 12-484 and 12-802; providing for severability and providing for an effective date. Be it ordained by the Board of County Commissioners of Bonner County, Idaho that Bonner County Code be amended the summary of which reads as follows: TITLE 12 LAND USE REGULATIONS 1) BCRC 12-332 RESIDENTIAL USE TABLE: Addition of the Vacation Rentals use to the Residential Use Table with the addition of reference note 12 which refers to the standards found in Section 12-484. 2) BCRC 12-333 COMMERCIAL USE TABLE: Removal of the Vacation Rentals use for the Commercial Use Table. 3) BCRC 12-484 VACATION RENTALS: Complete rewrite of the code section with significant modifications to procedures, standards, and violations. Applications now are required to contain the property number and a more detailed parking plan. The changes to the standards include: the permit being valid for one year, renewal timeframes, maximum occupancy calculation, the addition of a high occupancy standard, parking calculations, the location of parking spaces, posting the parking plan, sings, and the addition of an inspection standard. The changes to Violations and Penalties include: removal of the infraction section, removal of the penalties section, and updates to the revocation sections. 4) BCRC 12-484 Section E is copied below in accordance with I.C. § 31-715A: E. Violations: 1. Violations: Failure to comply with the occupancy limits or other requirements of the vacation rental permit and/or this section, shall constitute a violation. Disturbances or nuisances caused by the occupants (and their invited guests) of a vacation rental that violate Bonner County Revised Code or State Law, IC 18-6409, shall also constitute a violation. 2. Revocation: a. The Planning Director is hereby authorized to revoke any vacation rental permit, issued under the terms of this section, if, after due investigation, it is determined s that the holder thereof has received three (3) violations in a twelve (12) month period. b. A failing septic system, as identified by Panhandle Health District, shall result in a suspension of the vacation rental permit. Once the landowner has obtained approval of the repaired septic system the suspension shall be lifted. Operating a vacation rental with a suspended permit shall result in a revocation of the vacation rental permit. c. If a vacation rental permit is revoked, the landowner or their representative may not reapply for a vacation rental permit on the subject property for a period of one (1) year from the date of revocation. d. The applicant may appeal the Planning Director’s decision to revoke a vacation rental permit to the Board of County Commissioners, pursuant to the provisions of section 12-261 of this title. 5) BCRC 12-819 DEFINITIONS – B: Modification of the section adding a definition for “Bedroom”.
